Representative of an Overseas Business Visa

This route is specifically for overseas businesses that want to create a branch/subsidiary in the UK. A senior employee (sole representative) of the overseas business can apply to reside in the UK to undertake the task of opening the UK branch/subsidiary.  The representative should be authorised to make decisions on the company’s behalf and have the authority to establish and operate a registered branch/subsidiary.

The initial visa is granted for 3 years with the ability to extend for a further two years. Family members by way of a partner and dependent(s) under the age of 18 can also apply for the same term as the main applicant.  The sole representative and family members can apply for settled (permanent) status after completing 5 years of residence in the UK.

Under this route the overseas business is not required to demonstrate accessibility to a certain level of investment funds before they venture to the UK to establish their commercial presence. Under the Tier 1 Entrepreneur visa the applicant was required to demonstrate access to £200,000 for the purposes of their investment in the UK. There is no such requirement under the sole representative visa.

In terms of requirements the overseas business must show evidence of their business activity including assets and accounts. A detailed business plan setting out details of the proposed branch/subsidiary is also included as part of the requirements.
